Jamie Leigh Jones was drugged and gang-raped by her coworkers in the Green Zone while working for Halliburton/KBR. Following the incident, which left her beaten and deformed to the point she required reconstructive surgery, she was examined by a military doctor, who later turned over the medical findings and rape kit to KBR security. Rather than take punitive action against the assailants, KBR, a subsidiary of Halliburton, locked the victim in a shipping container for 24 hours without food or water, threatening that she would lose her job if she reported the incident to authorities. When Jamie Jones tried to take action against her employer she discovered that her employment contract had an arbitration clause within the lengthy document.

When considering her story I demand that the Arbitration and Fairness Act (H.R. 30-10) is passed. I don’t believe that when an employee is a victim of crime he/she should be forced into a mandatory arbitration which is not subject to appeal. The arbitration proceeding is private and discrete and the outcome of arbitration cannot be disclosed to the public. Unfortunately, these contracts are stacked in favor of businesses, making it harder for individuals to prevail in a dispute and that’s just wrong.
